What Your Business Is Required to Post

Both Federal and State agencies have workplace posting requirements. At a Federal level, employers are required to post information about mandated programs such as Family and Medical Leave Act and Equal Opportunity Employment. At a State level, the requirements change based on location and sometimes, even city or county within the state (hello California). It is important that all employers, regardless of size, understand the Federal and State requirements and keep their workplace postings up to date.

Remote Work Implications:

The increase of remote work does not eliminate the need for required postings. The labor code speaks to physically posting the information in a common area where all employees can view it. For remote employees, this means that employers should mail or email the required information and ask employees to print and post it in their home office. 

You can house the posters on a shared drive, or online hub, but since employees may not frequent those locations often, we suggest going the extra step of mailing or emailing.

If employees work in a hybrid situation and are in an office with required postings in a frequented common area, then you are not obligated to send posters via mail or email.

Language Implications:

If your business employs a large population of speakers where English is their second language, you are encouraged, and may be required to have postings in that common language. For example, many California and Texas employers have postings in both English and Spanish to accommodate their largest populations of employees.
